SC Grants Bail to Delhi CM Kejriwal in Excise Policy Scam Case
The Supreme Court has granted bail to Delhi Chief Minister Arvind Kejriwal in the Delhi excise policy scam case. Kejriwal, who had been arrested by the Enforcement Directorate (ED) and later by the Central Bureau of Investigation (CBI), has been in custody for nearly six months. The court ruled that Kejriwal satisfies the triple conditions required for bail, thus allowing his release.
Kejriwal was first arrested by the ED under the Prevention of Money Laundering Act (PMLA) on March 21, followed by a subsequent arrest by the CBI on June 26 while he was still in custody. The CBI’s decision to arrest him after almost two years without action raised concerns, with Justice Bhuyan highlighting that the agency only moved after Kejriwal was granted bail in the ED case.
The Supreme Court, while granting bail, noted that the trial’s completion is not imminent, and found no illegality in the CBI’s actions, despite the timing of the arrest being questioned. The judges also emphasized that there was no violation of legal procedures during the arrest.
Kejriwal’s legal team argued that the CBI’s arrest was an “insurance arrest” made only after his release in the ED case, implying it was unnecessary since the CBI had not acted for nearly two years prior. Despite these arguments, the court concluded that Kejriwal meets the conditions for bail and is therefore allowed to walk free.
