Delhi HC Issues Notice in Plea for Stray Animal Care
The Delhi High Court recently issued a notice to the Animal Welfare Board of India (AWBI) and other concerned authorities following a plea by Mala Tuli, a senior citizen seeking permission to feed and care for stray dogs and cats in her locality. The petitioner, a retired teacher, claims she has faced obstacles and harassment in her efforts to provide for these animals.
Legal Battle for Animal Care
In response to Tuli’s plea, Justice Subramonium Prasad has issued notices to AWBI, Delhi Police, MCD, and Pragati Vihar Hostel RWA. The court has scheduled further hearings for May 25, emphasizing the legal battle unfolding over the right to care for stray animals.
Obstruction and Harassment: A Growing Issue
Tuli, who has been feeding dogs for 16 years, alleges that recent hindrances from the local RWA and security guards have escalated. The petitioner claims that the RWA, unaware of animal laws, has enforced rules against feeding stray dogs, resulting in mental harassment and obstruction of her charitable activities.
Constitutional Rights and Legal Measures
Tuli’s plea argues a violation of her fundamental rights, asserting that the prevention of feeding and caring for stray animals infringes upon Article 21 of the Constitution of India. Despite previous court orders and guidelines, local authorities have allegedly failed to protect Tuli’s right to care for animals, leading to a larger legal debate on the treatment of speechless creatures.
