Article-370-Abrogation Enhances Rights for J-k Residents, Extends Progressive Laws
The Center announced on Wednesday that the abrogation of Article 370 has significantly improved the rights of residents in Jammu and Kashmir. Prior to this constitutional change, the people in the region were deprived of various progressive laws. Minister of State of Home Affairs, Nityanand Rai, addressed this development in response to a question in the Rajya Sabha.
Following the abrogation of Article 370 and the application of all provisions of the Constitution of India, Central Laws, which were previously not applicable to the erstwhile state of Jammu and Kashmir, have now been implemented in the Union Territory. Rai highlighted that after this constitutional amendment, numerous progressive laws, including the Right of Children to Free and Compulsory Education Act, 2009, the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the Whistle Blowers Protection Act, 2014, the Juvenile Justice (Care and Protection of Children) Act, 2015, the National Commission for Minorities Act, 1992, The National Commission for Safai Karmacharis Act, 1993, have been extended to Jammu and Kashmir.
The minister emphasized that residents of Jammu and Kashmir are now enjoying the same rights as citizens in other parts of the country. The abrogation of Article 370 has facilitated the extension and implementation of these laws, ensuring that the people in the region have access to the benefits and protections afforded to citizens elsewhere.
