Calcutta High Court Refuses Stay on Ritabrata Banerjee as West Bengal Opposition Leader, Seeks Speaker’s Detailed Order
Calcutta, June 12, 2026 [VoM News]: The Calcutta High Court has refused to grant a stay in the matter related to the appointment of expelled Ritabrata Banerjee as the leader of the majority bloc in the party and the official Leader of the Opposition (LoP) in the Assembly.
Assembly Speaker Rathindra Bose had recognised the expelled leader as the LoP.
The plea was heard by the single-judge vacation bench of Justice Krishna Rao, who refused to provide any immediate interim relief to the petitioner.
Pertinent to mention here that the bench questioned whether an MLA expelled from a political party could be recognised as the Leader of the Opposition without the formal approval of the concerned party.
However, the court stated that the Speaker’s detailed order needs to be produced before the court for further consideration of the matter.
Meanwhile, the Criminal Investigation Department is investigating the allegations of irregularities in the signatures submitted to the Speaker’s office regarding key appointments, following the complaint filed by Ritabrata Banerjee and another MLA, Sandipan Saha.
The All India Trinamool Congress is facing internal questions and a political crisis following the major split in the party. Sources said Ritabrata Banerjee has the support of around 60 to 65 MLAs, while nearly 20 MLAs continue to support party chief Mamata Banerjee and party national general secretary Abhishek Banerjee.
Once the Speaker’s detailed decision is produced before the court, it will be important to see how the court proceeds in the matter. At the same time, the CID investigation is expected to reveal whether there was any forgery or fabrication in the signatures submitted to the Speaker’s office.
