SC Advocates Transparency in J-K Internet Suspension Reviews
The Supreme Court, addressing concerns related to internet suspension in Jammu and Kashmir, has called for the publication of orders passed during the review of such suspensions. The bench, headed by Justices BR Gavai and Sanjay Karol, expressed the view that while deliberations may not need publication, the orders resulting from reviews should be made public. The court granted Additional Solicitor General KM Nataraj two weeks to seek instructions on this matter and scheduled the next hearing accordingly.
Foundation for Media Professionals Raises Concerns
A miscellaneous application was filed by the Foundation for Media Professionals, asserting that, despite the Supreme Court’s earlier ruling in the Anuradha Bhasin case, review orders on internet shutdowns were not being published. The court emphasized the importance of transparency in these matters, aligning with its previous stance on imposing restrictions only when “necessary” and “unavoidable.”
Awaiting Response from Jammu and Kashmir Union Territory
While the Jammu and Kashmir Union Territory argued that deliberations need not be published, the court insisted on transparency in the form of published orders during reviews. This development highlights the ongoing efforts to balance security considerations with the principles of transparency and citizens’ rights in regions affected by internet suspensions.
