J-K Reservation Act Amended: Landmark Move to Rectify Injustices and Restore Rights in Union Territory
On Tuesday, the Ministry of Home Affairs (MHA) officially implemented the provisions of the Jammu and Kashmir Reservation (Amendment) Act, 2023, a significant legislative move aimed at rectifying injustices and restoring rights to those who were deprived in the Union Territory. The notification, issued by Union Home Secretary Ajay Bhalla, designates December 26, 2023, as the effective date for the enforcement of the provisions outlined in the amendment.
This development follows the recent passage of the Jammu and Kashmir Reservation (Amendment) Bill, 2023, during the Winter Session of Parliament. The MHA, exercising powers conferred by subsection 2 of section 1 of the Jammu and Kashmir Reservation Amendment Act, formally announced the commencement of the amended provisions through the issued notification.
The legislative changes, which garnered unanimous approval in the Rajya Sabha on December 11, also included the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023. Both bills were earlier approved by the Lok Sabha during the Winter Session, aiming to redress grievances and restore rights to those who had faced injustice in the Union Territory.
Union Minister Amit Shah, speaking in the Rajya Sabha, highlighted the objectives of the bills. One of them focuses on representing individuals who became refugees in their own country, while it also reserves a seat in the Jammu and Kashmir Assembly for people displaced from Pakistan-occupied Kashmir (PoK).
The Jammu and Kashmir Reservation (Amendment) Bill, 2023, specifically amends the Jammu and Kashmir Reservation Act, 2004. The original act provided reservation in jobs and admissions to professional institutions for Scheduled Castes (SCs), Scheduled Tribes (STs), and other socially and educationally backward classes.
Simultaneously, the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023, seeks to amend the 2019 Act, ensuring representation in the Legislative Assembly for Kashmiri migrants and displaced persons from PoK. The proposed changes include nominating two members from the Kashmiri migrant community and one representative for displaced persons from Pakistan-occupied Kashmir (PoK) to the Legislative Assembly. Additionally, the amendment Bill suggests an increase in the number of seats in the Legislative Assembly from 83 to 90.
