Parliament Passes Bills Amending Jammu and Kashmir Laws
The Rajya Sabha passed two crucial bills, the Jammu and Kashmir Reservation (Amendment) Bill, 2023, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2023 with unanimous support.
These bills aim to amend key laws in the Union Territory, focusing on providing rights to individuals who faced injustice.
During the parliamentary proceedings, various Opposition leaders raised concerns about reinstating the statehood of the former state and holding elections there.
The bills, initially passed by the Lok Sabha last week, were discussed jointly following the Supreme Court’s ruling upholding the constitutional validity of the Executive Order that abrogated Article 370 and ended statehood for Jammu and Kashmir.
Union Minister Amit Shah, speaking in the Rajya Sabha, highlighted the historical importance of the bills for the region.
He emphasized the Supreme Court’s validation of the intentions behind the Jammu and Kashmir (Reorganisation) Bill, 2019, its constitutionality, and the due process followed.
Shah elaborated on the Bills’ provisions, mentioning that one aimed to represent refugees within the country and reserve a legislative seat for individuals displaced from Pakistan-occupied Kashmir (PoK).
He dismissed opposition criticisms and reiterated that due procedures were followed during the revocation of Article 370.
The Home Minister also underscored the increase in assembly seats after the delimitation exercise in Jammu and Kashmir. He added that seats have been reserved in PoK, affirming India’s claim over the region.
Several MPs from various parties participated in the debate. While Congress MP Rajani Ashokrao Patil emphasized reinstating Jammu and Kashmir’s statehood and prompt elections, other MPs shared diverse opinions.
MP Abdul Wahab expressed both support and opposition to the bills, while Fauzia Khan highlighted the impact of militancy in the region. BJP MP Gulam Ali praised the bills for benefiting Kashmir’s development, acknowledging a decline in militancy.
Congress MP Syed Nasir Hussain credited Nehru for integrating Kashmir into India. YSRCP MP V. Vijayasai Reddy supported the bills but criticized Congress for its approach to the Kashmir issue.
He suggested nominating members for vacant PoK assembly seats and increasing relief for migrants.
DMK MP Tiruchi Siva advocated for states’ rights within India’s constitutional framework, while Shiv Sena MP Priyanka Chaturvedi questioned the government’s timeline for Jammu and Kashmir elections.
The Jammu and Kashmir Reservation (Amendment) Bill, 2023 aims to amend the Jammu and Kashmir Reservation Act, 2004, ensuring reservation for various groups.
The Jammu and Kashmir Reorganisation (Amendment) Bill, 2023 proposes to increase assembly seats and nominate members for specific communities to the Legislative Assembly.
