Supreme Court Revives Cheating Case Against Mehul Choksi and Wife
In a significant development, the Supreme Court has reinstated a cheating case filed by the Gujarat Police against fugitive businessman Mehul Choksi and his wife. The order overturns a 2017 decision by the state high court, which had quashed the FIR against them. This setback comes amidst Choksi’s involvement in the Punjab National Bank (PNB) scam, where he and his nephew Nirav Modi are accused of defrauding the bank of over Rs 14,000 crore.
Allegations of Forgery and Cheating in Gold Bars Transaction
The FIR, originally registered in 2015 by complainant Digvijaysinh Himmatsinh Jadeja, accuses Mehul Choksi and his wife of forgery and cheating in connection with a business transaction involving 24 karat pure gold bars worth Rs 30 crore. The Supreme Court bench, consisting of Justices Sanjiv Khanna and SVN Bhatti, in its recent verdict, directed the police to proceed with the investigation, emphasizing the need to adhere to legal interpretations of relevant sections of the Indian Penal Code.
Judicial Scrutiny and the Path Forward
The Supreme Court criticized the high court’s detailed examination and evaluation of the case at a stage when the investigation was ongoing. The bench emphasized that disputed factual questions should be left for investigation and refrained from making detailed observations on these aspects. The court stressed the importance of ensuring that criminal offense criteria are met and refrained from commenting on specific roles until the investigation is complete.
