Sikh Marriages Acknowledged Under Anand Marriage Act in Jammu Kashmir
In a significant development, Sikh couples in Jammu and Kashmir are now empowered to officially register their marriages under the Anand Marriage Act within three months of solemnization.
The ‘Jammu and Kashmir Anand Marriage Registration Rules, 2023’ laid out by the administration specify that a late fee will be applicable if formalities are completed after the stipulated deadline.
This step fulfills a longstanding demand of the Sikh community, granting them the ability to have their marriages recognized independently under the Anand Marriage Act, distinct from the purview of the Hindu Marriage Act.
The Anand Marriage Act, established in 1909, was a legislative initiative by the British Imperial Legislative Council to honor and validate the Sikh wedding ceremony known as Anand Karaj.
The Act gained renewed attention in 2012 when the Anand Marriage (Amendment) Bill was introduced, aiming to extend legal recognition to traditional Sikh marriages. While the central government approved these amendments, the responsibility of framing specific rules for the registration of Anand marriages was delegated to individual states and Union territories.
This recent enactment in Jammu and Kashmir provides Sikh couples with a formal legal framework to register their marriages under the Anand Marriage Act, further acknowledging and respecting the customs and traditions of the Sikh community within the region.
