Legal Clash Over DefamationA Delhi court is set to resume proceedings on October 14th regarding an application filed by Rajasthan Chief Minister Ashok Gehlot. This application pertains to a defamation complaint lodged against him by Union Minister Gajendra Singh Shekhawat. At the heart of this legal tussle are Gehlot’s statements linking Shekhawat to the infamous Sanjivani scam, an alleged deception of thousands of investors involving approximately Rs 900 crore ($121 million) through the Sanjivani Credit Cooperative Society.
Refusal to Halt Proceedings
Special MP-MLA Court Judge M K Nagpal had previously declined to halt the legal proceedings in response to Gehlot’s request. However, Gehlot has been granted the opportunity to participate in the hearings via video conferencing. Currently, the case is under the jurisdiction of a magisterial court.
Shekhawat’s Defamation Allegations
Union Minister Gajendra Singh Shekhawat, who also holds the portfolio of ‘Jal Shakti’ Minister and represents Jodhpur in Parliament, has accused Ashok Gehlot of defaming him through various mediums. Shekhawat alleges that Gehlot’s press conferences, media reports, and social media posts have been orchestrated to tarnish his image and undermine his political career.
Judicial Perspective on Defamation
Additional Chief Metropolitan Magistrate Harjeet Singh Jaspal, presiding over the case, has made it clear that Gehlot is alleged to have made defamatory statements against Shekhawat knowingly and with the intent to damage his reputation. The judge has taken into account the argument put forth by senior advocate Vikas Pahwa, who represents Shekhawat. Pahwa contends that the complaint’s allegations find support from all the complainant’s witnesses during their testimonies.
Continuing Legal Battle
In essence, the ongoing legal battle between Ashok Gehlot and Gajendra Singh Shekhawat revolves around a defamation complaint brought forth by the Union Minister against the Rajasthan Chief Minister. The crux of the matter is Gehlot’s alleged public defamation of Shekhawat in connection with the Sanjivani scam.
