
Mehraj Malik PSA Case Fixed for February 05, Says Legal Advisor Appu Singh Salathia
Jammu, Jan 31: The Public Safety Act (PSA) case of Mehraj Malik saw a significant development on Saturday, with the High Court of Jammu & Kashmir and Ladakh directing that the matter be listed before an appropriate Bench after seeking instructions from the Hon’ble Chief Justice.

As per the order passed on January 29, 2026, by Justice Rajesh Sekhri, senior counsel Rahul Pant, appearing for the petitioner, submitted that the case had already been heard at length by a coordinate Bench of the High Court and would be expedited if it is listed before the same judge. Taking note of the submission, the court ordered the Registry to list the matter before the appropriate Bench after obtaining instructions from the Lord Chief Justice.
Earlier, following the transfer of the judge who was hearing the matter to Kashmir, it was being said as per reports that the court had offered Mehraj Malik the option of a fresh hearing before a new judge. However, Malik’s legal team declined the offer, citing the need for judicial continuity and consistency. The defence has since decided to approach the Hon’ble Chief Justice, seeking transfer of the case to the earlier judge, before whom the matter was substantially heard.
Next Hearing on February 05
Confirming the next date of hearing, Legal Advisor and Party Spokesperson Appu Singh Salathia said that the Mehraj Malik PSA case has now been fixed for February 05, 2026.
Salathia further stated that the case, being led by Senior Advocate Rahul Pant, has already been heard to a large extent, and a formal submission has been made seeking its transfer to the earlier judge for early conclusion. According to sources, the matter is likely to be taken up at the Srinagar Bench of the High Court.
Case Details
The Habeas Corpus Petition (HCP No. 139/2025) has been filed by Mehraj Din Malik through his father Shamas Din, a senior citizen, against the Union Territory of Jammu & Kashmir and others.
The petitioner is represented by Senior Advocate Rahul Pant, along with S. S. Ahmed and other advocates, while the respondents are represented by Ms. Nisha Kangotra, Advocate, appearing vice Ms. Monika Kohli, Senior AAG.
