
Mehraj Malik PSA Case: Defence to Approach CJ Seeking Transfer of Hearing to Justice Yousuf Wani
Jammu, Jan 29: In a significant development in the Public Safety Act (PSA) case of Mehraj Malik, the Honable judge who was earlier hearing the matter has been transferred to Kashmir, prompting a fresh procedural turn in the case says, the reports.
Sources further says that following the transfer, the court offered Mehraj Malik the option of having the proceedings heard afresh by a new judge. However, Malik’s legal team declined the offer, opting instead to continue the case from its present stage to avoid delays.
Subsequently, the defence formally demanded that the case be reassigned to the same honable judge who had been hearing the matter earlier, citing the importance of judicial continuity and consistency. Malik’s legal counsel is now set to approach the Hon’ble Chief Justice of the High Court of Jammu & Kashmir and Ladakh, seeking transfer of the hearing to Hon’ble Justice Yousuf Wani, added the source.
Case Listed for Final Hearing
Meanwhile, the High Court of Jammu & Kashmir and Ladakh at Jammu is scheduled to take up the Habeas Corpus Petition (HCP No. 139/2025) filed in connection with Mehraj Malik’s detention for final hearing on Thursday, as per Supplementary Cause List-1.
The petition has been filed by Mehraj Din Malik through his father, Shamas Din, a senior citizen, against the Union Territory of Jammu & Kashmir, represented by the Principal Secretary, Home Department, and other respondents.

Several connected applications—CM Nos. 7818/2025, 7819/2025, 6132/2025 and 6133/2025—are also listed for consideration.
Senior Advocate S. S. Ahmed is representing the petitioner, while Monika Kohli appears on behalf of the respondents. The matter is listed before Bench No. SB-VII, presided over by Justice Rajesh Sekhri. With the case marked for final hearing, the court may conclude arguments and pass appropriate orders.
Supporters of Mehraj Malik continue to closely follow the proceedings, awaiting the outcome of the case with heightened anticipation.
