Apple Temporarily Escapes U.S. Sales Ban on Watch Series 9 and Ultra 2
Following a patent dispute with medical device manufacturers Masimo Corporation and Cercacor Laboratories, Apple secured a brief respite from the U.S.
International Trade Commission’s (ITC) sales prohibition on its Watch Series 9 and Ultra 2 models within the United States. The dispute primarily centered around a pulse oximeter feature, leading to the initial ban imposed by the ITC.
Temporary Relief Amid Patent Infringement
Apple found itself embroiled in a patent infringement issue with Masimo, resulting in the prohibition of sales for its latest smartwatches – the Apple Watch Series 6 onwards and all versions of the Apple Watch Ultra. Notably, this ban did not extend to the Apple Watch SE. Despite an emergency appeal by Apple, the White House opted not to intervene in the matter.
However, Apple’s fortunes turned when the U.S. Court of Appeals for the Federal Circuit granted a temporary stay on the sales ban.
This reprieve allows Apple a window until January 12 to present its redesigned models of the disputed Apple Watches to the U.S. Customs Department for evaluation.
The Ban’s Impact and Future Prospects
The embargo on the sale of Apple’s Watch Series 9 and Ultra 2 commenced on December 26 due to the patent-related dispute with Masimo Inc.
Swift action by Apple, filing an emergency appeal motion, prompted an interim pause in the sales prohibition.
There’s a possibility of Apple devising product redesigns to comply with patent issues, potentially paving the way for the Watches’ return to the market.
