
Waqf Amendment Act 2025: Top Court to hear a batch of petitions today
A three-member bench of the Supreme Court, comprising Chief Justice Sanjiv Khanna, Justice Sanjay Kumar, and Justice Viswanathan, will hear a batch of petitions challenging the constitutional validity of the Waqaf Amendment Act 2025.
This development came after the Centre assured the Supreme Court that it would not denotify any property, and not make any appointments to the central or state councils until the next scheduled hearing on May 5.
Solicitor General Tushar Mehta argued against any form of interim stay, stating that the law was duly passed by the Parliament of India following due deliberations and enjoys the presumption of constitutionality.
As an assurance was given by the Centre, the Court took note of it and directed that no worker properties, including those in long-standing use, be disturbed until the next hearing scheduled for today. The Court also directed and granted the Centre one week’s time to file its preliminary response in the case.

The Ministry of Minority Affairs submitted an affidavit comprising 1,332 pages, opposing any kind of blanket stay or interim relief. It contended that any interference would amount to creating a legislative regime through judicial order. The government has argued that the Act does not interfere with any essential religious practices and maintains that it leaves prayer and worship unaffected.
The three-member bench will now hear the petitions.
