Calcutta High Court Sets Aside Prohibitory Orders in Sandeshkhali
Court Rules Against Section 144 Promulgation, Citing Procedural Issues
The Calcutta High Court, responding to a petition from two Sandeshkhali residents, has overturned the imposition of prohibitory orders under Section 144 of CrPC in the region. Justice Jay Sengupta declared the promulgation of Section 144 as improper, emphasizing procedural concerns. The residents argued that the prohibitory orders were enacted without a valid foundation, limiting people’s right to protest. The state countered, asserting the need to evaluate whether there were sufficient grounds for the protests and addressing alleged violence associated with some demonstrations.
Backdrop of Protests in Sandeshkhali
Week-long Protests Over Atrocities and Land Grabbing
Sandeshkhali, previously in the spotlight for an attack on ED officials during a raid at a Trinamool Congress leader’s premises, has experienced protests for the past week. The demonstrations revolve around allegations of atrocities against women and land grabbing by individuals linked to the ruling party. The Calcutta High Court’s decision aims to address concerns over the procedural aspects of imposing prohibitory orders and uphold the right to protest.
