SC Seeks Centre’s Response on Organ Transplantation Compliance
The Supreme Court has issued notice to the Centre in response to a petition urging the enforcement of compliance with Sections 14 and 14-A of the Transplantation of Human Organ (Amendment) Act 2011. The petition, filed by Gaveshna Maanvotthan Paryavaran Evam Swasthya Jaagrookata Samiti, through advocate Varun Thakur, aims to ensure that government or semi-government medical colleges and district hospitals meet the Act’s requirements and are registered with the National Organ and Tissue Transplant Organization (NOTTO).
Key Points Raised in the Petition
The petitioner emphasizes the need for compliance with legal provisions to enhance organ transplantation capabilities in government or semi-government medical colleges and district hospitals. The petition draws attention to the high number of fatal road traffic accidents (RTA) in India, with associated head injuries accounting for a significant percentage. It underscores the potential for organ donation from RTA victims and those with cerebrovascular accidents (CVAs).
The petition contends that the deceased donor pool in India could be expanded by harvesting organs from patients with fatal injuries or conditions. It calls for the implementation of the “Report of the Task Force on Organ Donation and Transplantation” provided by YK Chawla in 2022. The petition also highlights the low rate of organ donation in India compared to other countries.
Importance of Organ Donation for Deceased Donor Pool
The petition stresses that enhancing organ donation procedures aligns with fundamental rights and human dignity. It emphasizes the importance of implementing reasonable, fair, and just legal procedures to uphold fundamental rights, including the right to life with dignity.
