Justice Aniruddha Bose Joins Supreme Court Collegium Following Justice Kaul’s Retirement
Following the retirement of Justice Sanjay Kishan Kaul, the Supreme Court’s five-judge Collegium has now welcomed Justice Aniruddha Bose.
This key committee recommends candidates for elevation to the Supreme Court and facilitates the transfer of High Court judges.
The newly formed Collegium comprises Chief Justice DY Chandrachud, along with Justices Sanjiv Khanna, BR Gavai, Surya Kant, and Justice Bose, whose tenure in the collegium extends until April 10, 2024.
With Justice Kaul’s departure, Justice Gavai now joins the Chief Justice and Justice Khanna in the three-judge collegium, responsible for suggesting appointments of judges to the High Courts.
Justice Kaul, during a hearing related to names cleared by the Collegium pending with the government, raised concerns about the government’s intervention in judicial seniority through what he termed as “selective” appointments and transfers of High Court judges.
He cautioned that such actions might trigger responses from the Collegium, potentially leading to “embarrassing” outcomes.
In earlier statements, Justice Kaul had explicitly advised the Centre against selectively bypassing individuals recommended by the Collegium for judicial appointments based solely on their political affiliations or their legal stances against the government in court.
He expressed deep concern regarding the government’s approach, labeling their practice of “pick-and-choose policy” in appointing and transferring High Court judges as a matter of grave concern.
