SC-Forms Committee to Address Lawyer Adjournment Procedures Amidst Concerns and Circular Changes
The Supreme Court has established a committee of judges tasked with formulating a standard operating procedure (SOP) for lawyers seeking adjournment of proceedings. This move follows concerns raised by the Supreme Court Bar Association and the Supreme Court Advocate on Record Association regarding circulars issued by the apex court, which announced the discontinuation of the practice of circulating adjournment slips.
The committee has extended an invitation to the Bar and other stakeholders to contribute their suggestions on the matter. This development is in response to two circulars issued by the Supreme Court on December 5 and 22, directing the discontinuation of the practice of circulating adjournment slips until December 15, 2023. The circular emphasized the need to list the maximum number of cases during the winter vacation, with a provision for genuine difficulties to request adjournments directly before the concerned court.
After various bar bodies expressed their concerns, the Supreme Court issued a subsequent circular on December 22. Acknowledging the request from the Supreme Court Bar Association and the Supreme Court Advocate on Record Association to continue the circulation of adjournment slips, the Competent Authority decided to form a Committee of Hon’ble Judges. This committee is entrusted with preparing a Standard Operating Procedure, inviting suggestions from the Bar and all stakeholders, and working on further modalities. In the interim, the practice of circulating adjournment slips remains discontinued until further orders.
The Supreme Court Bar Association has urged its members to submit suggestions by January 2, 2024, specifically focusing on legitimate grounds for seeking adjournments. Chief Justice D Y Chandrachud had previously urged lawyers not to seek adjournments in fresh matters, expressing a desire to avoid the Supreme Court gaining a reputation as a ‘tarikh-pe-tarikh’ court, emphasizing that such delays undermine the trust of citizens.
