Proclamation Under Section 82 of CrPC, Warning of Property Attachment

A court in Jammu and Kashmir’s Kishtwar district has declared 13 Pakistan-based terrorists as proclaimed offenders, a significant move that may lead to the attachment of their properties if they fail to appear before the court within 30 days, according to officials.

The proclamation notice, issued under section 82 of the Code of Criminal Procedure (CrPC), was served to the families of these terrorists in different parts of Kishtwar. The delivery of the notice was accompanied by the beating of drums, a symbolic act to draw attention to the declaration.

Kishtwar’s Senior Superintendent of Police (SSP), Khalil Poswal, explained that these 13 local terrorists, who are believed to be operating from across the border, have been making repeated attempts to revive terrorism in the district. They were declared proclaimed offenders after they failed to respond to non-bailable warrants issued earlier by the special NIA court in March. These warrants were issued in connection with a terror-related case registered at the Kishtwar police station last year, which includes various sections of the Indian Penal Code and the Unlawful Activities (Prevention) Act.

Poswal emphasized that if these proclaimed offenders do not surrender within 30 days, the authorities will initiate proceedings to attach their properties under section 83 of the CrPC.

In the proclamation notices served at the birthplaces of these absconding terrorists, Additional District and Sessions Judge Doda Sudesh Sharma made it clear that the accused could not be found despite the warrants of arrest issued by the court of additional sessions judge in Jammu. The notices stated that it had been demonstrated to the court’s satisfaction that the accused had absconded or were concealing themselves to avoid arrest. The notices warned that if the accused fail to appear before the court within 30 days from the date of the proclamation, proceedings under section 83 of the CrPC would be initiated against them.

The list of proclaimed offenders includes individuals like Shahnawaz Kanth, alias “Umer,” Nayeem Ahmed, alias “Amir,” Mohammad Iqbal, alias “Bilal,” Shahnawaz, alias “Nayeem,” and Javid Hussain Giri, alias “Muzamil.” Other names on the list are Bashir Ahmed Mughal, Gazi-ul-Din, Sattar Din, alias “Saifullah,” Imtiyaz Ahmed, alias “Dawood,” Shabir Ahmed, Mohammad Rafig Keen, Muzaffer Ahmed, and Azad Hussain.

This development reflects the region’s continued efforts to combat terrorism and bring those involved in such activities to justice.
