Former JNU student leader Umar Khalid has approached the Delhi High Court seeking bail in a case filed under the Unlawful Activities Prevention Act (UAPA) in connection with the 2020 Delhi riots. Khalid has been in custody since September 2020. Despite the filing of charge sheets and supplementary charge sheets, the investigation continues.
His earlier bail petition was rejected by the trial court, prompting Khalid to seek relief from the High Court. The petition is set for hearing before a division bench headed by Justice Prathiba M Singh on Monday. On May 28, the Karkardooma Court denied Khalid regular bail, referencing the High Court’s order that stated allegations against Khalid were prima facie true and did not merit bail.
Special Judge Sameer Bajpai noted, “The High Court analyzed the case against the applicant and concluded that allegations against the applicant are prima-facie true, applying section 43D(5) of UAPA.” The court emphasized that the High Court had conducted a “surface analysis” of the evidence, sufficient to determine a prima facie case against Khalid.
Given the High Court’s previous dismissal of Khalid’s criminal appeal on October 18, 2022, and his subsequent withdrawal of the petition from the Supreme Court, the trial court’s March 24, 2022, order attained finality. Khalid’s bail applications have been dismissed twice, with the court noting that it could not reanalyze the case facts as requested.
Khalid remains in custody and seeks regular bail under Section 437 of the Code of Criminal Procedure, 1973, and Section 43D (5) of the Unlawful Activities Prevention Act, 1967.
