SC Upholds Article 370 Revocation: Sibal Calls Verdict Trailblazing, Congress Disagrees
Providing his initial reflections a day after the Supreme Court validated the Centre’s decision to revoke Article 370 from the former state of Jammu and Kashmir, senior advocate and ex-Congress leader Kapil Sibal expressed on Tuesday that the verdict was ‘trailblazing’ for many and ‘heartrending’ for others.
Sibal maintained that, despite appearances, the court’s ruling was unrelated to the government’s interpretation of Article 370, which had granted special constitutional privileges to the erstwhile state. The moving finger of the court moves on…With no surprises!”In a momentous decision on Monday, the apex court upheld the Union government’s move to annul Article 370, which had conferred specific privileges on the former state of Jammu and Kashmir.
The court contended that decisions made by the Centre on behalf of a state cannot be subjected to legal challenges. The historic verdict was delivered by a five-judge Constitution bench, comprising Chief Justice of India DY Chandrachud, along with Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant.CJI Chandrachud, delivering the judgement, emphasized that decisions taken by the Centre on behalf of a state, under a proclamation, should not be open to legal challenges, as it would paralyze the administration of the state.
In response to the court’s endorsement of the revocation of Article 370 from the former state, Union Home Minister Amit Shah, speaking in the Rajya Sabha during a debate on Jammu and Kashmir’s draft legislations, argued that the abrogation, initiated by Prime Minister Narendra Modi in 2019, curtailed separatism in the region, averting the loss of innocent lives to violence and terrorism.
Despite the court’s validation, the Congress party, on Monday, expressed its disagreement with the judgement, asserting that it upheld the Centre’s abrogation of Article 370 from Jammu and Kashmir. P Chidambaram, Congress Rajya Sabha MP, conveyed during a press conference at the party headquarters, “We respectfully disagree with the judgment on the manner in which Article 370 was abrogated.”
