SC Sets Deadline for Maharashtra Speaker to Decide on Disqualification Petitions
The Supreme Court, on Monday, issued a directive to Maharashtra assembly Speaker Rahul Narwekar, ordering him to make a decision on the disqualification petitions against Maharashtra Chief Minister Eknath Shinde and the supporting MLAs by December 31, as reported by PTI. This development comes after the court’s previous admonishment of Narwekar for the prolonged delay in adjudicating the disqualification petitions.
The Supreme Court expressed its concern regarding the dignity of the court, emphasizing the importance of complying with court orders. On October 18, the court had already urged the Maharashtra assembly speaker to provide a realistic timeframe for the hearing of disqualification petitions against Shiv Sena MLAs. The court has warned that the disqualification decisions must be made before the next assembly elections to ensure the process remains meaningful.
The disqualification petitions stem from a series of actions taken by Sena factions last year when Chief Minister Eknath Shinde and 39 MLAs split from the parent party to join the BJP in forming a government. In July, the speaker had issued notices to 54 MLAs, 40 from the Shinde-led Sena and 14 from the Thackeray faction, seeking their responses to the disqualification petitions.
Notably, the Supreme Court had ruled in May that Eknath Shinde would continue to serve as the Chief Minister of Maharashtra, and it could not reinstate the Maha Vikas Aghadi (MVA) coalition government led by Thackeray, as Thackeray had chosen to resign without undergoing a floor test following Shinde’s rebellion.
Throughout this process, the Shiv Sena (UBT) has accused Speaker Narwekar of intentionally delaying the decision on the disqualification petitions, while Narwekar had previously expressed the need to avoid rushing the decision to prevent a “miscarriage of justice.”
