SC Rejects Manish Sisodia’s Bail Pleas in Alleged Excise Policy Scam
In a significant legal development, the Supreme Court on Monday rejected the bail pleas of former Delhi deputy chief minister Manish Sisodia in a case related to an alleged excise policy scam. Sisodia has been in custody since his arrest by the Central Bureau of Investigation (CBI) on February 26 for his purported involvement in the ‘scam’.
The bench of Justices Sanjiv Khanna and SVN Bhatti presided over the bail pleas and directed that the trial procedure in the case should be concluded within six to eight months. Furthermore, the apex court stated that if the trial process proceeds at a slower pace, Sisodia would have the option to re-apply for bail at a later stage.
The court’s decision was influenced by the fact that a substantial sum of ₹338 crore had been tentatively established in connection with the case. The bench remarked, “In the analysis, there are certain aspects which are doubtful regarding the transfer of ₹338 crore.”
Previously, the Supreme Court had conveyed to the Enforcement Directorate that if the alleged bribe, paid in relation to the now-scrapped Delhi excise policy, is not considered part of the predicate offence, it would be challenging to prove the money-laundering case against Sisodia. The court emphasized the importance of not relying on assumptions when building a case and insisted on granting protection under the law.
Manish Sisodia’s legal troubles extended beyond the CBI arrest, as the Enforcement Directorate also took him into custody in a money-laundering case stemming from the FIR filed by the CBI. The charges against him in the money-laundering case were deemed ‘very serious in nature’ by the high court, which denied him bail earlier. The Supreme Court, in a previous ruling on May 30, declined his bail plea, noting his high-profile status and potential to influence witnesses due to his past roles as deputy chief minister and excise minister.
