Global Adoption of GPS Tracking
While this technology is new to India, it has been widely adopted in various Western countries, including the United States, the United Kingdom, South Africa, Australia, and New Zealand. These nations have used GPS tracking to monitor individuals on bail, parole, or house arrest effectively. By doing so, they have been able to significantly reduce prison congestion.
The Special NIA Court’s Directive
The introduction of these GPS tracker anklets in Jammu and Kashmir was prompted by a directive from the Special NIA Court, Jammu. This court issued an order, underscoring the importance of closely monitoring terror accused individuals and imposing stringent conditions for granting bail under the Unlawful Activities (Prevention) Act, 1967.
Ensuring Accountability
One case that drew attention to the need for such monitoring involved accused Ghulam Mohd Bhat. He had applied for bail while facing charges related to his association with various terrorist organizations and his involvement in terror financing on behalf of the proscribed terrorist organization Hizbul Mujahideen (HM). Bhat had been arrested during an attempt to transport proceeds of terrorism amounting to Rs 2.5 lakh on HM’s behalf. Additionally, he had been convicted by the NIA Court Patiala House, Delhi, in a separate case related to his association with a terrorist organization and conspiracy to commit a terrorist acts.
