Delhi Court Issues Warning Against False Pleas in North East Delhi Riots Case
In a matter related to the North East Delhi riots, the Karkardooma Court in Delhi cautioned a lawyer against making false pleas or attempting to mislead the court deliberately. Additional Sessions Judge Pulastya Pramachala issued the warning during the hearing of a riots case lodged at Police Station New Usman Pur in 2020. The court’s order, dated December 23, 2024, sternly warned the counsel, Sanawar Chaudhary, against the practice of making false statements or attempting to keep the court uninformed intentionally.
Counsel Criticized for Changing Statements During Proceedings
The court’s order highlighted a sequence where Chaudhary initially claimed that advocate Mehmood Pracha would arrive in five minutes, and later changed the statement, citing Pracha’s unavailability due to feeling unwell. The court, noting its disapproval of such practices in the past, warned against their repetition. Despite this, Chaudhary proceeded with the cross-examination on behalf of the accused after offering to do so himself.
Deferred Cross-Examination and Future Proceedings
While the court allowed Chaudhary to conduct cross-examination, the proceedings for accused Firoz Khan were deferred as his counsel was reported to be unwell. The court advised the accused to consider alternative arrangements. The cross-examination for Firoz Khan is scheduled for February 16, 2024.
This legal development underscores the court’s emphasis on maintaining integrity in legal proceedings, with a specific warning against misleading practices that may undermine the judicial process. The court’s directive serves as a reminder of the importance of transparency and truthfulness in presenting cases before the judiciary.
