“An Advocate Has a Basic Duty to Scrutinise Jurisdiction Before Approaching Court”: Judge Amarjeet Singh Langeh

JAMMU, October 10, 2026 [VoM News]: 1st Additional District Judge Jammu, Amarjeet Singh Langeh, has observed that an advocate has a basic duty to carefully scrutinise the jurisdictional aspects of a matter before approaching the court.

The observation was made while dismissing a revision petition filed by Prem Sagar Khajuria against an order dated March 6, 2025, passed by the 2nd Additional Munsiff, Jammu, whereby a written statement filed by the defendant, Jaswant Singh, was taken on record.

Judge Amarjeet Singh Langeh observed that Section 115 of the Code of Civil Procedure (CPC) vests revisional jurisdiction in the High Court and does not confer such jurisdiction upon the court hearing the revision petition.

“The instant revision petition is therefore wholly mis-conceived,” the judge observed, holding that the court lacked the statutory jurisdiction to entertain the matter.

Emphasising the responsibility of legal practitioners, Judge Langeh further observed that resorting to a procedurally incompetent remedy without verifying its statutory basis causes an avoidable wastage of precious judicial time and places an unwarranted strain on judicial resources.

The court accordingly dismissed the revision petition as not maintainable.

The order was pronounced on October 10, 2026.
