Delhi HC Issues Notice to Central Government Over Hindon Air Force Station Operations

Justice Subramonium Prasad of the Delhi High Court has issued a notice to the Central Government based on a plea by Delhi International Airport Limited (DIAL). The plea challenges the continued commercial operations at Hindon Air Force Station. DIAL argues that allowing regular commercial operations at Hindon Air Force Station would adversely affect their interests. The court has directed the Central Government and others to file a reply, and the matter is scheduled for further hearing on March 7.

Legal Battle Unfolds: DIAL Challenges Ministry’s Decision

DIAL, represented by Advocate Milanka Chaudhary, is contesting the Ministry of Civil Aviation’s decision from October 31, 2023, allowing the Airports Authority of India to start scheduled commercial flight operations at Hindon Air Force Station in Ghaziabad, Uttar Pradesh. The petition also challenges the note from April 17, 2023, proposing the cancellation of the Memorandum of Understanding (MOU) dated November 10, 2017, which permitted the use of Hindon Airforce Station for specific flights under the Regional Air Connectivity Scheme (‘RCS’) as an interim arrangement.

Questioning the Establishment of a Greenfield Airport

Senior advocate Arvind Nigam argued on behalf of DIAL, asserting that Hindon Air Force Station does not qualify as a greenfield airport. He emphasized that the decision, proposal, and communication regarding increased flight operations at Hindon Air Force Station contradict the Ministry’s own policies, particularly the 1997 Policy on Airport Infrastructure. Nigam pointed out that this policy discourages the development of a new airport within 150 kilometers of an existing one, a parameter he claims Hindon Air Force Station falls within. The petition seeks the quashing of the communication from October 31, 2023, inviting airline operators to increase flight operations at Hindon Air Force Station.
