    In a landmark ruling, the Tripura High Court’s single bench has directed the state government to ensure that all Anganwadi workers in the state receive gratuity benefits under the Payment of Gratuity Act, 1972, retroactively. Advocates representing 22 petitioners hailed the judgement as a victory for Anganwadi workers’ rights.

    The judgement mandates that all Anganwadi workers and helpers, even retirees, employed under the Integrated Child Development Services (ICDS) scheme, become eligible for gratuity upon reaching superannuation. The court invalidated a departmental order that previously denied gratuity benefits to these workers.

    Advocate Purushuttam Roy Barman, representing the petitioners, emphasized the court’s directive for timely gratuity payment within 30 days post-retirement, with accrued interest for any delays. He underscored the High Court’s alignment with a previous Supreme Court ruling affirming Anganwadi workers’ entitlement to gratuity benefits, applicable nationwide.

    The ruling affects approximately 10,000 Anganwadi workers and helpers in Tripura, ensuring fair compensation for their dedicated service and upholding their rights in alignment with judicial precedent.
