Supreme Court’s Firm Stance on Workplace Harassment
In a defining move for workplace ethics and women’s safety, the Supreme Court of India has firmly reinstated a punitive measure against a former Service Selection Board employee following allegations of sexual harassment. The apex court’s decisive action overturns the Gauhati High Court’s earlier verdict, which had annulled the penalty, and reinforces the judicial system’s commitment to addressing the serious issue of harassment in the workplace.
Repercussions for the Accused
The bench, led by Chief Justice DY Chandrachud, has underscored the importance of penal actions in cases of sexual harassment by upholding the decision to withhold 50 percent of the accused’s pension. While the court acknowledged the receipt of the appeal from the central government, it was unequivocal in its criticism of the High Court’s “egregious error.” The top court has set aside the 2019 judgment and reinstated the penalty on Dilip Paul, the accused, while also stipulating that there should be no retroactive financial recovery.
