Supreme Court’s Concerns on Pre-Trial Injunctions
The Supreme Court recently underscored the potential adverse impact of pre-trial injunctions on the freedom of speech and the public’s right to information.
The bench, comprising Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra, cautioned against the indiscriminate granting of injunctions, particularly in defamation cases involving media articles
While acknowledging the importance of protecting reputation and privacy, the court emphasized the need to strike a balance with the fundamental right to free speech, especially in cases concerning media platforms and journalists.
Guidelines for Judicial Intervention
The apex court laid down guidelines, stating that injunctions should only be granted in exceptional cases where the respondent’s defence is certain to fail at trial. It stressed the importance of conducting a full-fledged trial or providing the respondent with an opportunity to present their case before imposing restrictions on publication.
The court’s remarks came in response to Bloomberg’s plea challenging a trial court’s order directing the removal of an allegedly defamatory article against Zee Entertainment. The court observed that such injunctions could stifle public debate and should be approached cautiously.
