Supreme Court Upholds Framing of Charges
In a recent ruling, the Supreme Court affirmed that even a strong suspicion, based on material on record, is sufficient to justify the framing of charges in a criminal case. Justices Vikram Nath and KV Viswanathan emphasized that the court’s role at the preliminary stage is not to rehearse the trial but to consider whether there is enough evidence to proceed with the charges.
No Quashing of Charges in Disproportionate Assets Case
The bench, in its 46-page judgment, declined to quash the framing of charges in a disproportionate assets case. Justice Viswanathan stressed that a strong suspicion, grounded on material on record, is adequate to presume the existence of factual elements of an offense, warranting the framing of charges against the accused.
Appeals Against High Court Judgment
The appeals were filed by Puneet Sabharwal and RC Sabharwal, challenging the Delhi High Court’s decision. The high court had upheld the trial court’s order from 2006, which framed corruption charges against them. Despite the appeals, the Supreme Court directed the trial court to expedite the trial, which had been pending for 25 years.
