Over 50% of Notified Gram Nyayalayas Now Operational, Bridging Justice Gaps
As per recent government data presented in the Lok Sabha, 284 gram nyayalayas (rural courts) are currently operational out of the 479 notified by various states across the country.
This significant stride is a testament to the efficacy of the Gram Nyayalayas Act enacted in 2008, with the primary objective of ensuring access to justice at citizens’ doorsteps.
In response to a query, Law Minister Arjun Ram Meghwal clarified in a written reply that, according to the law, it is not obligatory for states to establish such courts.
Instead, the onus rests on state governments to initiate the establishment of gram nyayalayas, working in consultation with their respective high courts.
“The state governments, after consultation with the respective HCs may, by notification establish one or more Gram Nyayalayas for every panchayat at intermediate level or a group of contiguous panchayats at intermediate level in a district or where there is no panchayat at intermediate level in any state, for a group of contiguous gram panchayats,” highlighted Meghwal.
Crucially, the minister emphasized that the decision to set up additional gram nyayalayas lies with the states, allowing flexibility to cater to their specific requirements.
This decision-making process involves collaboration and consultation with their respective high courts.
