
Kishtwar Court Acquits Man in Abduction and Rape Case Due to Lack of Evidence
KISHTWAR, MAY 11, 2026 [VoM News]: While giving relief and the benefit of doubt, a Kishtwar court has acquitted a person accused of allegedly abducting and raping a married woman.
The court, in its decision, observed that the prosecution had failed to prove the charges beyond reasonable doubt, whereas the investigation also consisted of lapses and shortcomings.
As per the prosecution, a married woman was allegedly abducted in June 2021 when she was travelling toward her parental home. The accused, who was reportedly known to her through her husband, had allegedly offered her water containing an intoxicating substance. The prosecutrix stated that she had boarded the accused’s vehicle, and after consuming the water offered to her, she lost consciousness. When she regained consciousness, she found herself in a forest area, where she was allegedly subjected to sexual assault over several days.
After not finding her at the destination, the woman’s husband filed a missing complaint. She was later recovered from Batote, and the accused was arrested, after which charges were framed by the trial court.
The court observed shortcomings in the investigation and material evidence. The court highlighted that the vehicle was not traced, nor were the officials involved in the investigation and recovery put on record. Those who informed the complainant about the woman’s disappearance were also not put on record.
Similarly, the role of the driver was also not established, which the victim had mentioned in her statement.
The court found the prosecution case doubtful and extended the benefit of doubt to the accused, acquitting him of all charges.
The court also directed the discharge of bail bonds and release of seized bonds, if any, in accordance with the law after the expiry of the appeal period.
