Delhi High Court Raises EWS Admission Income Threshold
The Delhi High Court has mandated an increase in the income threshold for admission under the Economically Weaker Section (EWS) quota in Delhi schools. The limit has been raised from Rs 1 lakh to Rs 5 lakh annually, pending further amendments by the government. This decision aims to align the income criteria with the living standards of the beneficiaries of the scheme. The court has also instructed the Delhi government to replace the self-declaration of income by parents with a more robust framework.
Case of Misuse Leading to Policy Change
This judgment follows a case where a man secured his son’s admission in a prestigious Delhi school under the EWS category using falsified documents. The court dismissed the petition challenging the cancellation of the boy’s admission but allowed him to continue as a general category student. The court imposed a Rs 10 lakh fine on the father for illicitly obtaining the admission, thereby depriving a deserving candidate of the opportunity.
Revisiting EWS Reservation Criteria
Justice Purushaindra Kumar Kaurav highlighted the misuse of the EWS reservation scheme by affluent individuals. He emphasized the need to reassess the income criterion for EWS admissions, particularly in a metropolitan context where living costs are higher. The court noted that with the minimum wage for unskilled labor in Delhi being Rs 17,494 per month, an annual income limit of Rs 1 lakh is unrealistic for families seeking EWS benefits. The judgment reflects a commitment to ensuring equitable education standards for all socio-economic sections.
