Delhi HC Declines Urgent Hearing on Neelam Azad’s Plea in Parliament Security Breach Case
Neelam Azad’s plea for immediate release from Delhi Police custody, associated with the Parliament security breach case, was rejected an urgent hearing by the Delhi High Court.
The vacation bench scheduled the matter for a regular hearing on January 3, 2023, declining to address it during the vacation period.
Azad, through Lawyer Advocate Suresh Kumar, alleged her arrest was illegal, violating Article 22(1) of the Constitution. She claimed her family was informed about her arrest only in the evening despite being detained in the afternoon.
Azad’s plea questioned the legality of the trial court’s remand order, citing her lack of access to her chosen legal representative during the remand proceedings, which, according to her, contradicted constitutional rights activated upon arrest.
The High Court had previously stayed the trial court’s directive to Delhi Police, directing the supply of an FIR copy to Azad, following a challenge from the police.
The court also issued notices to Azad in response to the Delhi Police plea. Earlier, the Patiala House Court granted Azad’s family’s request for an FIR copy and access to her lawyer for legal advice during the custodial remand.
The case involves a security breach incident on December 13, where individuals entered the Lok Sabha chamber, set off smoke cans, and raised slogans.
Investigations disclosed that two pairs of shoes were specially ordered from Lucknow to smuggle smoke cans into the new Parliament, exploiting lax footwear security checks.
