Delhi Court Summons BJP Leader Syed Shahnawaz Hussain on Rape Allegation
A Delhi court has taken a significant step by summoning BJP leader Syed Shahnawaz Hussain following a woman’s complaint accusing him of rape and criminal intimidation. The court has considered the gravity of the alleged offense and has directed the former Union minister to appear before it on October 20.
Court’s Thorough Review
The court’s decision to summon Shahnawaz Hussain was based on a comprehensive examination of various factors, including the cancellation report, the protest petition filed by the complainant, the investigating officer’s response to the protest petition, and other related evidence. The judge noted that the complainant consistently maintained her statements to the police, the court, and before the learned Magistrate under section 164 of the Cr.PC.
Rejection of Police Report
The judge firmly dismissed the police report seeking the cancellation of the FIR. The judge clarified that the issues raised by the investigating officer in the cancellation report are matters that should be addressed during the trial phase. Additionally, the court expressed the view that the complainant’s version and credibility should be tested in a trial setting, particularly during cross-examination by the accused.
Cognisance of Offenses
As a result, the judge took cognisance of the alleged offenses. These offenses encompass a range of provisions under the Indian Penal Code (IPC), including section 376 (rape) and section 506 (criminal intimidation). In light of these serious allegations, the court has summoned accused Syed Shahnawaz Hussain through the Station House Officer (SHO) of the concerned police station for the next hearing.
