False Assurance Leads to Tragic Road Mishap
In a recent development, Mahindra Group Chairman Anand Mahindra and 12 others have found themselves facing a criminal case in Kanpur, triggered by a complaint lodged by Rajesh Mishra. This grievous complaint alleges that false assurances regarding the safety of a four-wheeler ultimately led to the tragic demise of Rajesh Mishra’s son in a road mishap.
The Complainant’s Heartbreaking Tale
Rajesh Mishra’s heart-wrenching ordeal began when he purchased a Black Mahindra Scorpio SUV for Rs 17.39 lakh on December 2, 2020. His decision was heavily influenced by advertisements and social media posts endorsed by Anand Mahindra, which strongly emphasized the vehicle’s safety features.
Rajesh Mishra then gifted the SUV to his son, Dr. Apoorv Mishra, with the utmost confidence in its safety claims. However, tragedy struck on January 14, 2022, when Dr. Apoorv was traveling from Lucknow to Kanpur in the same SUV. Despite all occupants wearing their seat belts (as noted in the police report), the vehicle collided with a divider due to heavy fog, resulting in a fatal accident.
Allegations of Deception and Negligence
Rajesh Mishra’s complaint asserts that he would never have made the ill-fated purchase had the manufacturer not assured him of the vehicle’s safety. Furthermore, it alleges that despite the seat belts being in use, the car’s airbags failed to deploy, leading to the tragic loss of his son’s life. Shockingly, investigations have revealed that there were no airbags in the vehicle as claimed.

Legal Action and Ongoing Investigation
The Raipurwa police have filed a First Information Report (FIR) against Anand Mahindra and others under several sections of the Indian Penal Code, including charges of cheating, negligent conduct with respect to machinery, causing death by negligence, intentional insult with intent to provoke breach of the peace, criminal intimidation, and criminal intimidation causing a death. The case is currently under investigation, with law enforcement authorities diligently examining the evidence and circumstances surrounding this tragic incident.
This case serves as a stark reminder of the importance of truth in advertising and the responsibilities manufacturers bear when making safety claims about their products. It highlights the legal challenges faced by individuals seeking justice for accidents caused by alleged corporate negligence and false assurances in the realm of vehicle safety.
