CPI (M) Leader Mohammad Yousuf Tarigami Contemplates Supreme Court Appeal on Article 370 Abrogation
Senior CPI (M) leader Mohammad Yousuf Tarigami expressed his dissatisfaction with the recent court decision upholding the abrogation of Article 370 in the former state of Jammu and Kashmir.
He emphasized the need for justice, mentioning ongoing discussions among petitioners and stakeholders to explore avenues for obtaining it.
Tarigami hinted at the possibility of filing an appeal with the Supreme Court of India, seeking a reevaluation of the recent ruling.
“We believe justice was not served in the recent ruling, and we are actively consulting stakeholders to prepare potential applications for a Supreme Court appeal,” Tarigami affirmed.
He raised concerns about misleading narratives being disseminated to portray the benefits of revoking Jammu and Kashmir’s special constitutional status.
Referring to the LG Manoj Sinha’s statement that the Anand Marriage Act’s implementation in Jammu and Kashmir became possible due to Article 370’s abrogation, Tarigami highlighted numerous amendments made to Article 370, allowing the application of Central laws to the region.
He underlined the passage of GST in 2017 by the Jammu and Kashmir Assembly and noted 42 constitutional orders extending central intervention in Jammu and Kashmir that were not envisioned during the adoption of Article 370.
Tarigami also cited instances of Article 370’s misuse, particularly an order issued in July 1986 under which Article 249 of the Constitution was extended to the state.
This allowed Parliament to legislate on state list matters based on a resolution from the Rajya Sabha, demonstrating a unique level of central encroachment exclusive to Jammu and Kashmir.
Tarigami’s statements reflect ongoing debates and discussions regarding the implications and aftermath of the revocation of Article 370 in Jammu and Kashmir.
