Approach of New Criminal Law Bills Towards Individuals ‘Hiding in Other Countries’
Union Home Minister Amit Shah unveiled provisions in the new criminal law bills enabling trials in absentia for individuals evading justice by hiding in foreign countries, especially for acts of terrorism or other offenses committed in India.
Speaking in the Lok Sabha during the discussion on Bharatiya Nyaya (Second) Sanhita, Bharatiya Nagarik Suraksha (Second) Sanhita, and Bharatiya Sakshya (Second) Bill 2023, Shah emphasized the provision to continue trials in the absence of the accused after a stipulated period if they fail to appear within 90 days.
Shah defended the inclusion of the trial in absentia provision, questioning the sympathy towards criminals who flee the country after committing severe offenses such as terror attacks, citing incidents like the Mumbai bomb blasts.
He reiterated that those eluding trials abroad should face legal repercussions, stressing the necessity to expedite the legal process and change their status in the foreign country where they are being prosecuted.
Asserting that these new criminal law bills align with the Constitution’s spirit and prioritize the welfare of the nation’s citizens, Shah highlighted their significance in replacing archaic laws like the Indian Penal Code of 1860, the Code of Criminal Procedure (CrPC) of 1973, and the Indian Evidence Act of 1872.
The bills passed in the Lok Sabha, namely Bharatiya Nyaya (Second) Sanhita 2023, Bharatiya Nagarik Suraksha (Second) Sanhita 2023, and Bharatiya Sakshya (Second) Bill 2023, will replace the IPC, CrPC, and Evidence Act respectively.
