Stay on Proceedings for Model Code and Covid Norms Violation
The Allahabad High Court has put a halt to the criminal proceedings initiated against Samajwadi Party chief Akhilesh Yadav. These proceedings were related to alleged violations of the model code of conduct and Covid norms during the Uttar Pradesh assembly polls in 2022. The stay order came from a local court in Gautam Budh Nagar district on a case registered at the Dadri police station, which also involved Rashtriya Lok Dal (RLD) chief Jayant Chaudhary and others.

Justice Raj Beer Singh, hearing Akhilesh Yadav’s application, issued the stay and requested a response from the state government’s counsel. The case has been scheduled for further hearing on January 21. In his petition, Yadav challenged both the charge-sheet and the criminal proceedings against him.
Contentions Raised by Yadav’s Counsel
Yadav’s counsel, Imran Ullah, argued that cases involving guideline violations require a complaint from the individual whose order was disobeyed, which was not followed in this instance as the FIR was directly filed by the police. He also pointed out discrepancies in the case diary and questioned the validity of the allegations, particularly the likelihood of Yadav spreading Covid infection when he was not suffering from the disease himself. Furthermore, Ullah highlighted that all witnesses in the case were police personnel with identical statements, raising doubts about their reliability.
