Tribunal Formed to Assess JKDFP’s Unlawful Status

    The Central Government has taken action by establishing a tribunal under the jurisdiction of Delhi High Court Judge Sachin Datta to determine whether there are sufficient grounds to declare the Jammu and Kashmir Democratic Freedom Party (JKDFP) as an unlawful association. This development follows the Union Ministry of Home Affairs declaring JKDFP an unlawful association earlier this month. The Ministry issued a notification on Monday, outlining the formation of the tribunal to address this matter.

    Reasons for the Tribunal’s Formation

    The Ministry of Home Affairs had previously designated JKDFP as an unlawful association, citing its activities as “anti-India” and “pro-Pakistan.” The tribunal, under the Unlawful Activities (Prevention) Act, 1967, is tasked with assessing whether there is just cause for declaring JKDFP as an unlawful association.

    The tribunal will be led by Justice Sachin Datta, a judge at the Delhi High Court, and its decision will have significant implications for JKDFP’s legal status.

    Background on JKDFP and Shabir Ahmad Shah

    Founded in 1998 by the imprisoned separatist Shabir Ahmad Shah, JKDFP was once a part of the separatist amalgam Hurriyat Conference. Following the division of the Hurriyat Conference in 2003, JKDFP aligned itself with the hardline faction led by Syed Ali Shah Geelani. Shabir Ahmad Shah, currently held in Delhi’s Tihar Jail, was arrested by the Enforcement Directorate (ED) in 2017 as part of a 2005 money laundering case. He has also been charged by the National Investigation Agency (NIA) in a terror-funding case.

    The Enforcement Directorate had attached Shah’s Srinagar residence in November last year in connection with a money laundering investigation linked to alleged support for terror activities in the Union territory.
