Houston, September 11, 2023: A Hyderabad-based cloud computing company, Pi Data Centers, has achieved a significant legal victory against global enterprise IT services provider Hewlett Packard Enterprises (HPE). Pi Data Centers took HPE to the US District Court for the Southern District of Texas, alleging overbilling and failure to adhere to processes.
Case Background
The dispute centers around a contract initiated in 2018 between Pi Data Centers and HP India. The contract’s purpose was to provide cloud computing infrastructure to the Andhra Pradesh government. However, Pi Data Centers grew concerned that HP India and its associates had inaccurately estimated the cloud computing requirements of the Andhra Pradesh government. They believed that the contracted capacity was excessive, with low utilization rates. As a result, Pi Data Centers approached HP India to reconsider the contract.
Subsequently, one of HP India’s local partners filed a lawsuit against Pi Data Centers, claiming unpaid arrears. To resolve this issue, Pi Data Centers reluctantly settled the demands.
Allegations and Legal Action
Following the settlement, Pi Data Centers contacted HPE in the US, alleging that HP India had provided misleading information regarding the quantum of computing resources required by the Andhra Pradesh government. They argued that this violated HPE’s Code of Conduct. HPE responded by confirming that an investigation had taken place but provided no further details.
Frustrated by HPE’s response, Pi Data Centers sought legal recourse in the Texas court. The lawsuit accuses HPE and its Indian affiliates of deliberately providing false information about the Andhra Pradesh government’s cloud computing needs, failing to maintain accurate records, improperly invoicing or overcharging for services, and making false demands and claims. The lawsuit alleges negligence, breach of fiduciary duty, and negligent misrepresentation.
Court Ruling
HPE attempted to dismiss the petition, arguing, among other things, that its global code of conduct was aspirational and not legally binding. However, the US court rejected most of HPE’s objections, including the assertion that the code of conduct was aspirational.
The court determined that the language in the Partner Code of Conduct outlined specific requirements that must be followed, making it legally enforceable. The court criticized Hewlett Packard for failing to investigate as promised.
While the court allowed Pi Data Centers to pursue its legal remedy, it dismissed one charge – that of negligent misrepresentation. The court has granted Pi Data Centers the opportunity to file an amended complaint against HP Enterprise by October 25.
Conclusion
Pi Data Centers’ legal victory represents an important milestone in the dispute over alleged overbilling and contractual issues with HPE. The court’s ruling confirms that HPE’s code of conduct carries legal obligations, providing a path for Pi Data Centers to seek appropriate redress for its grievances.
