India Plans AI-Specific Regulations Amid Growing Concerns Over Privacy, Bias

In response to the growing complexities and risks associated with Artificial Intelligence (AI), the Government of India has undertaken significant measures to ensure responsible AI development and deployment. While existing laws, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023, provide a legal foundation, the government is working towards a specialised regulatory framework to address AI-specific concerns such as bias, accountability, and data privacy.

The Ministry of Electronics and Information Technology has emphasised the ‘AI for All’ approach, aligning with the Prime Minister’s vision of democratising AI technology while ensuring safeguards. To this end, the government has approved the IndiaAI Mission, a strategic initiative aimed at establishing a robust and inclusive AI ecosystem. The mission focuses on seven key pillars: IndiaAI Compute, IndiaAI FutureSkills, IndiaAI Startup Financing, IndiaAI Innovation Centre, IndiaAI Datasets Platform, IndiaAI Applications Development Initiative, and Safe & Trusted AI.

A major regulatory initiative under this mission is the Safe & Trusted AI pillar, which promotes AI safety, security, transparency, and privacy. To mitigate AI-related risks, the government has launched eight Responsible AI Projects covering critical areas such as AI bias mitigation, synthetic data generation, machine unlearning, ethical AI frameworks, privacy-enhancing tools, and algorithm auditing. Leading institutions such as IIT Jodhpur, IIT Roorkee, and IIIT Delhi are spearheading these projects, contributing to the development of indigenous AI governance tools.

Furthering its commitment to responsible AI, the government has invited expressions of interest for additional projects focusing on deepfake detection, AI risk assessment, watermarking, and ethical AI frameworks. A total of 420 proposals have been received, indicating strong stakeholder engagement.

In parallel, the government has constituted an Advisory Group on AI under the leadership of the Principal Scientific Advisor to the Prime Minister. This group, consisting of experts from academia, industry, and government, has conducted a public consultation on AI governance guidelines, receiving over 100 suggestions. The consultation process underscores India’s commitment to a balanced approach that fosters AI innovation while ensuring regulatory oversight.

Beyond regulatory measures, India is fostering AI research and development through the establishment of three Centres of Excellence (CoEs) in AI, focusing on healthcare, sustainable cities, and agriculture. The government is also providing significant support to AI startups through initiatives such as the IndiaAI Innovation Challenge and the Technology Incubation and Development of Entrepreneurs (TIDE 2.0) Scheme, which have collectively supported over 100 AI startups.
