The Special Investigation Team (SIU) of Jammu and Kashmir Police has taken significant steps in the pursuit of justice and security by affixing proclamation orders on the residences of four active terrorists associated with Lashkar-e-Taiba (LeT). These orders require the individuals to appear in court within 30 days, or their properties will be subject to attachment.
Terrorists on the Run
The four terrorists identified as Umais Ahmed Wani, Basit Ahmed Dar, Owais Ferooz, and Momin Gulzar are wanted in connection with multiple terror cases and have been evading authorities. The designated and special court under the NIA Act, Srinagar, issued general non-bailable warrants against these individuals, establishing their involvement in various cases.
Legal Provisions at Play
Under Section 83 of the Code of Criminal Procedure (CrPC), a court can issue a proclamation against an individual facing a warrant who is evading law enforcement. This proclamation orders the accused to appear before the court within 30 days from the date of publication. Failure to comply can result in proceedings under Section 83 of CrPC, including the attachment of the individual’s movable or immovable property.
Efforts to Ensure Compliance
The SIU team, in collaboration with police teams from districts Kulgam and Awantipora, took action by affixing these proclamation orders on the residences of the absconding terrorists. The orders were also published in local newspapers and prominently displayed in the towns where they resided. To ensure understanding and awareness, the contents of the proclamation orders were communicated to the accused’s family members in a comprehensible language.
Affiliation with LeT
The individuals in question maintain active affiliations with the banned terrorist outfit Lashkar-e-Taiba (LeT), making their apprehension of utmost importance to maintain peace and security in the region.
The issuance of proclamation orders serves as a significant step in the efforts to bring these terrorists to justice and curb their unlawful activities. It also demonstrates the commitment of law enforcement agencies to uphold the rule of law and protect the safety and security of the region.
