Supreme Court to Review DGP Kundu’s Challenge Against High Court’s Transfer Order
In a significant development, the Supreme Court has scheduled a hearing on January 3 for Himachal Pradesh Director General of Police (DGP) Sanjay Kundu’s plea. Kundu is contesting the High Court’s directive to transfer him to a different post, aimed at preventing his alleged influence on the investigation concerning the harassment case of businessman Nishant Sharma in Palampur.
Represented by senior advocate Mukul Rohatgi, Kundu sought an urgent listing of the case, stating that the High Court didn’t grant the police officer a fair hearing before passing the order on December 26. The High Court had instructed the state government to relocate Kundu without allowing him to present his side of the case.
The Supreme Court, prompted by Rohatgi’s request, agreed to an immediate hearing, scheduled for the next day after the plea’s submission.
As a repercussion of this legal dispute, Sanjay Kundu was removed from his position as Himachal DGP and appointed as Principal Secretary in the Ayush department.
The High Court’s order, issued on December 26, mandated the State government to transfer both the DGP and Kangra Superintendent of Police Shalini Agnihotri to different roles by January 4, 2024, to prevent potential interference in the ongoing investigation.
The businessman, seeking protection due to fear of threats from influential figures, urged the High Court for intervention. Notably, the High Court clarified that its order didn’t imply any opinion on the case’s merits since the investigation remained incomplete at that time.
