Imran Khan Moves Supreme Court, Challenging IHC’s Decision on Toshakhana Case
Imran Khan, the founder of Pakistan Tehreek-e-Insaf (PTI), has filed a petition in the Supreme Court to contest the Islamabad High Court’s (IHC) ruling in the Toshakhana case, as reported by Geo News.
The plea aims to lift the ban imposed on him, allowing him to participate in the upcoming general elections after being “disqualified” from holding public office for five years.
The recent move follows the IHC’s dismissal of Khan’s plea seeking the suspension of the trial court’s verdict in the Toshakhana case.
In his initial plea to the IHC, which had previously suspended his sentence, Khan sought to annul the conviction.
However, in the latest petition to the Supreme Court, Khan emphasized the need for the IHC’s decision to suspend his sentence to also nullify the entire order of conviction from the trial court.
He argued that only suspending his sentence has denied his fundamental right to contest elections, resulting in his disqualification under Article 62(1)(f) of Pakistan’s Constitution.
The petition highlighted the denial of Khan’s constitutional rights, including the right to contest elections, due to the Election Commission of Pakistan’s action based on the suspended sentence without granting him an opportunity to be heard.
Earlier, on December 21, the IHC bench dismissed Khan’s request for suspending his conviction, declaring his petition as not maintainable on the last day for nomination paper submissions.
Imran Khan, a former international cricket star, has faced political turmoil since his ousting in a parliamentary no-confidence vote in April 2022.
He was sentenced to three years in prison on charges of selling state gifts during his tenure as prime minister (2018-2022), which he vehemently denies. Seeking to overturn this conviction barring him from electoral participation, Khan’s pursuit has led to an appeal to the Supreme Court following the rejection of the plea by the Islamabad High Court.
