Delhi High Court Asks Authorities to Consider Linking Aadhaar with Property Documents
The Delhi High Court has urged the Centre, Delhi government, and relevant authorities to deliberate on a public interest litigation (PIL) requesting the linkage of Aadhaar with property documents.
BJP Leader Ashwini Kumar Upadhyay filed the plea, seeking direction to associate movable and immovable property documents with individuals’ Aadhaar numbers.
The bench of Justice Rajiv Shakdhar and Justice Girish Kathpalia instructed the respondents to reach a decision within three months regarding Upadhyay’s plea.
Treating the plea as representation, the court mandated a three-month deadline for the concerned authorities to deliberate on this matter.
Earlier, the court had involved the Ministry of Finance, Ministry of Housing & Urban Affairs, Ministry of Rural Development, and Ministry of Law as parties in the case, allowing additional time for the Delhi government and the Home Ministry to express their stance on the plea.
Furthermore, the court had directed the petitioner to amend the petition by including more relevant ministries.
Advocate Ashwini Kumar Upadhyay highlighted the significance of linking property documents with Aadhaar to tackle corruption, black money generation, and benami transactions.
The plea emphasized the potential for a 2% annual growth increment if the government integrates property records with Aadhaar. It aimed to cleanse the electoral process plagued by black money and benami dealings that influence power dynamics.
The petition underscored India’s struggle with implementing legislation, particularly citing the Benami Transactions (Prohibition) Act, 1988, and its amended version in 2016.
Despite these measures, the plea argued that activities to detect benami properties progressed slowly, necessitating robust action by the government to combat corruption and illegal wealth accumulation.
Highlighting the need to send a clear message against corruption and illicit wealth, the plea emphasized executive action to deter corrupt practices, reinforce the rule of law, and ensure transparency within the system.
