SC Declines DCPCR Plea, Urges Resorting to Delhi High Court for Resolution
The Supreme Court, while addressing a plea from the Delhi Commission of Protection of Child Rights (DCPCR) concerning its fund freeze, stated that it cannot address all disputes between the Delhi government and the Lieutenant Governor (LG) under Article 32.
During the hearing, Chief Justice of India DY Chandrachud clarified that the Supreme Court primarily focuses on broader constitutional matters, suggesting that issues between the Delhi government and the LG should be addressed by the Delhi High Court.

He conveyed this stance while interacting with senior advocate Gopal Sankaranarayanan, representing DCPCR.The senior advocate emphasized the Commission’s independent status from the Delhi government, expressing concern over the freezing of their funds by the Centre.
However, the bench remained disinclined to intervene and directed Sankaranarayanan to seek recourse through the Delhi High Court.Sankaranarayanan also apprised the bench about the retirement of the Commission’s member and Chairperson on November 30. In response, the bench instructed the transfer of proceedings to the Delhi High Court through the Supreme Court’s registry.
This decision follows the Supreme Court’s recent refusal to entertain a plea from the Delhi government contesting the LG’s decision to terminate the services of civil defence volunteers functioning as marshals in DTC buses. The court advised the AAP government to pursue the matter in the Delhi High Court.
In November, the LG approved the Delhi government’s proposal for an inquiry into alleged fund misuse by DCPCR, along with a special audit of its accounts.
Pending the completion of the audit, the LG directed that no additional funding requests from DCPCR should be considered. The DCPCR, a statutory watchdog for child rights matters in Delhi, operates independently within the purview of the Delhi government.
