Pakistan’s SC Issues Notices on Plea Against Deportation of Illegal Afghans
Islamabad: The Supreme Court (SC) has taken a significant step by issuing notices to the federation, apex committee, and foreign ministry in response to a plea against the deportation of illegal Afghans residing in Pakistan, as reported by ARY News on Friday.
Since the apex committee of the National Action Plan (NAP) set a deadline in its October 3 meeting, chaired by Caretaker PM Anwaarul Haq Kakar, nearly 300,000 illegal Afghans have returned to their homeland via the Torkham and Chaman borders. The committee gave foreign nationals living illegally in Pakistan until October 31 to leave voluntarily or face deportation.
Constitutional Interpretation and Refugee Rights in Focus
The plaintiff argues that the caretaker government lacks the authority to evict illegal foreign nationals. As the Supreme Court delves into the matter, the bench remarked that the deportation of Afghan nationals residing illegally in Pakistan is a subject of constitutional interpretation.
During the hearing, Justice Ayesha Malik emphasized the importance of UN pacts regarding refugees, stating that these agreements ensure their rights, and Pakistan is bound by them as a signatory. Justice Sardar Tariq sought assistance in addressing the complex issue of whether illegal Afghan nationals, residing in Pakistan for the last four decades, should be allowed to continue living in the country.
