The Supreme Court of India has rejected a peculiar plea seeking to establish a single “constitutional religion” in the country. The court questioned the petitioner about his attempt to curtail people’s freedom to practice their respective religions.
Baffling Request
A bench comprising Justices Sanjay Kishan Kaul and Sudhanshu Dhulia expressed bewilderment at the petitioner’s request and inquired about the basis for such an unusual petition.
Petitioners-in-Person
The petition was filed by individuals Mukesh Kumar and Mukesh Manveer Singh, who appeared in court as petitioners-in-person. This designation is given to individuals who are not lawyers but have been granted permission to present their cases.
The Unfounded Demand
The petitioner, who identified as a social activist, filed a public interest litigation (PIL) under Article 32 of the Constitution on behalf of the people of India, seeking the establishment of “one constitutional religion.” However, the court questioned the rationale behind this request and asked the petitioner to explain his basis.
Lack of Specifics
The bench pointed out that the petition sought the quashing of a constitutional order from 1950 but failed to specify which constitutional order it was referring to. In light of this, the court promptly dismissed the petition.
